The Site, the App, and all related services, including account creation, newsletter subscriptions, push notifications, in-app content and functionality, and any other functionality we make available, are collectively referred to as the "Services."

2. What Information Do We Collect?

In Short: We collect personal information that you provide to us, as well as information collected automatically when you use the Site, the App, or the Services.

When you access the Site, use the App, create an account, subscribe to a newsletter, or use the Services in any way, we may collect Personal Data and Anonymous Data from you. We may also collect Personal Data and Anonymous Data automatically through cookies, pixels, tags, and similar technologies, through third-party tools and technologies integrated into the App, or through third-party partners such as advertising technology vendors, analytics providers, and visitor identification services. The information that we collect, and how that information is used depends on how you use the Site, the App, and the Services.

"Personal Data" means any data relating to an identified or identifiable individual, as defined by applicable privacy or data protection laws, including, for example, and without limitation:

  • your Internet Protocol (IP) address;
  • your approximate location as inferred from your IP address;
  • your cookie IDs, device IDs, advertising IDs, and other online identifiers;
  • hashed identifiers used for matching or recognition purposes;
  • audience segments, interest profiles, and demographic inferences derived from your browsing activity or cookie data;
  • information related to your subscription or account status, if applicable; and
  • your account password or authentication credentials.

Personal Data may be collected when you: (i) access the Site or use the App; (ii) create an account, subscribe to a newsletter, or purchase a subscription; (iii) interact with advertisements, content, or embedded games on the Site or within the App; (iv) visit areas of the Site or App that power partner experiences such as browser new tab pages; (v) apply for any employment opportunities with QMN; and/or (vi) grant device permissions, receive push notifications, or otherwise interact with App features. QMN does not knowingly collect any sensitive personal data or any data defined under special categories under Applicable Data Law (as defined in Section 8.1).

"Anonymous Data" refers to data about you that is not associated with or linked to your Personal Data. Anonymous Data does not permit the identification of individual persons. Anonymous Data may include, for example:

  • web browser type;
  • operating system type and version;
  • aggregated or generalized location data such as country or region;
  • date and time stamps of your visits;
  • Uniform Resource Locators (URLs) and referring URLs; and
  • aggregated usage and browsing patterns.

We may use Anonymous Data for market research purposes and to improve the Site, the App, and the Services. We may share Anonymous Data with our affiliated companies, selected third parties, and business partners. Where Anonymous Data is associated with or linked to your Personal Data, we treat the combined information as Personal Data and handle it in accordance with this Privacy Policy.

3. How Do We Use Your Information?

In Short: We process your information to provide, improve, and administer our Services, deliver advertising, communicate with you, for security and fraud prevention, and to comply with law.

  • to build audience segments, inferences, and interest profiles based on browsing activity for advertising and content personalization;
  • to identify visitors to the Site through third-party visitor identification services for marketing and analytics purposes;
  • to collect usage data from partner-powered content experiences, such as browser new tab pages, for analytics, monetization, and reporting;
  • to collect analytics and diagnostics data, including app performance metrics, crash reports, and usage statistics, to monitor, troubleshoot, and improve the Services; and
  • when you submit or provide your Personal Data, resume, CV, or other job application information to QMN via email, the Site, a third-party website, or other means.

We may sell or share for cross-contextual behavioral advertising purposes the following categories of personal information to or with advertising partners, visitor identification partners, and identity resolution providers:

We do not knowingly sell or share the personal information of consumers under 18 years of age.

We may use your personal information for our own business purposes, such as for undertaking internal research for analytics and service improvement. This is not considered to be "selling" or "sharing" of your personal information.

5. Lawful Basis for Processing Data

In Short: We process your personal data only where we have a valid legal basis, such as your consent, a contractual obligation, a legal requirement, or our legitimate business interests.

Where required by Applicable Data Law, we process your Personal Data on one of the following lawful bases:

  • Consent: targeted advertising, cookies and similar tracking technologies, visitor identification, and push notifications. You may withdraw your consent at any time as described in the Your Choices section.
  • Contract: account creation, subscription access, and newsletter delivery.
  • Legitimate interest: analytics, fraud prevention, ad quality monitoring, content optimization, and marketing communications.
  • Legal obligation: responding to lawful requests from authorities and complying with applicable law.

6. When and With Whom Do We Share Your Personal Information?

In Short: We may share your information with affiliates, service providers, advertising partners, and in connection with legal obligations or corporate transactions.

We will only use, share, and transfer any Personal Data, or any Anonymous Data that may contain Personal Data, for purposes defined under this Privacy Policy.

6.1 We may share your Personal Data in the following circumstances:

  • Subsidiaries and Affiliates. We may share your Personal Data with our affiliates, including our parent company and any subsidiaries, joint venture partners, or other companies that we control or that are under common control with us, for marketing and technical operations purposes.
  • Legal and Protective Purposes. In certain special cases, we may use, retain, disclose, and share Personal Data when we have reason to believe that using, retaining, disclosing, and/or sharing this information is necessary to identify, contact, or bring legal action against someone who may be causing injury to you, or otherwise injuring or interfering with QMN's rights, property or operations, other users of the Site, and/or the Services, or anyone else who could be harmed by such activities. We may also use, retain, or disclose your Personal Data when we believe the law requires it, or in response to any demand by law enforcement authorities in connection with a criminal investigation, or civil or administrative authorities in connection with a pending civil case or administrative investigation.
  • Service Providers. We may share your Personal Data with carefully selected companies that provide services for or on behalf of us, such as data hosting, content delivery, analytics, advertising, email marketing, visitor identification, ad quality monitoring, consent management, video content, payment processing, and affiliate monetization. These providers are committed to protecting your Personal Data and may only use it to provide services to us. Certain third-party partners, such as visitor identification and identity resolution providers, may also independently collect data through cookies and similar technologies on the Site for their own purposes. In such cases, these partners' own privacy policies govern their independent use of that data.
  • Corporate Transactions. We may disclose your Personal Data to a third party as part of a merger, acquisition, sale, or in the event of a bankruptcy.

7. Your Choices

In Short: You can opt out of marketing emails and push notifications at any time. You may also manage cookie preferences and opt out of third-party marketing.

We offer you choices regarding the collection, use, and sharing of your Personal Data.

  • Email Newsletters. You can opt out of our newsletters at any time by following the unsubscribe instructions in the email, updating your preferences on the Site, or by contacting us at privacy@qz.com. You may still receive transactional or service-related communications after opting out. Opting out of our emails does not opt you out of communications from third parties; you must unsubscribe with them directly.
  • Push Notifications. You can manage or disable push notifications at any time through your device settings.
  • Service Communications. Even if you opt out of marketing communications, we may still send you notices about updates to the Site, the App, the Services, and this Privacy Policy.
  • Withdrawing Your Consent. Where we rely on your consent to process your personal information, you may withdraw it at any time by contacting us at privacy@qz.com, using the consent management tool on the Site, or updating your device settings. Withdrawal does not affect the lawfulness of processing that occurred before you withdrew.

8. Your Rights With Respect to Your Personal Data

In Short: Depending on where you live, you may have the right to access, correct, delete, or restrict processing of your personal data, and to opt out of targeted advertising and data sales.

8.1 For the purposes of this Privacy Policy, "Applicable Data Law" means all applicable data protection and privacy laws, regulations and self-regulatory codes, including without limitation: European Data Law; U.S. Data Privacy and Protection Laws; and any other data privacy law or regulation in any jurisdiction; in each case as may be amended, supplemented, or superseded from time to time.

"European Data Law" means the EU General Data Protection Regulation ("EU GDPR"), the EU e-Privacy Directive; the UK General Data Protection Regulation ("UK GDPR"); the Swiss Federal Act on Data Protection ("Swiss FADP"); and any national laws made under or pursuant to the foregoing. "U.S. Data Privacy and Protection Laws" means, in each case to the extent applicable: the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020, and its implementing regulations (collectively, "CCPA"); the Virginia Consumer Data Protection Act ("VCDPA"); the Colorado Privacy Act and its implementing regulations ("CPA"); the Utah Consumer Privacy Act ("UCPA"); the Connecticut Data Privacy Act ("CTDPA"); and any other applicable state or federal law or regulation related to the protection of personal information in the United States.

8.2 Your Rights Under Applicable Data Law

In accordance with Applicable Data Law, you may have the following rights in respect of your personal information that we collect and hold:

  • Right of access and portability. The right to obtain access to and to receive your Personal Data.
  • Right to rectification/correction. The right to obtain rectification of your Personal Data without undue delay where that personal information is incorrect, inaccurate or incomplete.
  • Right to erasure/deletion. The right to obtain the erasure/deletion of your Personal Data without undue delay in certain circumstances, such as where the Personal Data is no longer necessary in relation to the purposes for which it was collected or processed.
  • Right to restriction. The right to obtain the restriction of the processing undertaken by us on your Personal Data in certain circumstances, such as where the accuracy of the Personal Data is contested by you, for a period enabling us to verify the accuracy of that Personal Data.
  • Right to object/opt-out. The right to object, on grounds relating to your particular situation, to the processing of your Personal Data, and to object to processing of your Personal Data for direct marketing purposes, targeted advertising, and profiling activities.
  • Right to non-discrimination. The right not to receive discriminatory treatment for exercising your privacy rights.

We reserve the right to limit or deny your request to view, update, or remove your Personal Data if you have failed to provide us with sufficient information to verify your identity.

Under certain U.S. state privacy laws, you can designate an authorized agent to make a request on your behalf. We may deny a request from an authorized agent that does not submit proof that they have been validly authorized to act on your behalf in accordance with applicable laws.

In accordance with Applicable Data Law, you have certain rights with respect to the processing of your Personal Data. Under Applicable Data Law, you have a right to request that we provide you with the following:

  • Categories of information. The categories and specific pieces of personal information we have collected about you.
  • Categories of sources. The categories of sources from which we collect Personal Data.
  • Purpose. The purposes for collecting, using, sharing, or transferring Personal Data.

8.4 Appeals

Under certain U.S. state privacy laws, if we decline to take action regarding your request, you may appeal our decision by emailing us at privacy@qz.com. We will inform you in writing of any action taken or not taken in response to the appeal, including a written explanation of the reasons for the decisions. If your appeal is denied, you may submit a complaint to your state attorney general.

9. Cookies and Similar Technologies

In Short: We use cookies, pixels, and similar technologies on the Site, and comparable tools within the App, to deliver content, serve ads, and analyze how you use the Services. You can manage your cookie preferences through your browser settings.

A cookie is a small piece of text that is sent to your web browser by the Site. The cookie helps the Site remember information about your visit, which makes your next visit to the Site easier and the Site more useful to you. We also use cookies and other similar technologies, and within the App, other tools and technologies that perform comparable functions, for tracking and reporting purposes, to make the ads that you may see more relevant to you, and to count how many visitors we receive to a page on the Site. The information collected by cookies and other similar technologies is used to enhance your experience on the Site, for marketing analysis, for targeted and display advertising, and for quality improvement of the Site. When you visit the Site, authorized third-party technologies operate concurrently with your visit to collect device and browser information, such as IP addresses and user agent strings, in real time for identity resolution and security purposes.

Please note that by choosing to opt-out of tailored advertising, you are opting out of behavioral targeting. This means that you will continue to receive advertisements on the Site and within the App; however, such advertisements will not be specifically targeted to you and your interests. Your opt-out choice will be stored in an opt-out cookie on your browser. If you delete/clear your browser cookies, such action will delete the opt-out cookie preference on your browser which will require you to revisit/set your behavioral targeting preferences again.

10. Third-party Relationships

In Short: The Site and the App may contain links to, content from, or integrations with third-party websites, advertisers, and technology providers. These third parties have their own privacy practices, and we are not responsible for them.

10.1 Third-party Links - The Site and the App may contain links to other third-party owned and/or operated websites or services and, where you request information from third-party providers, QMN may transfer you directly to the websites of such third-party providers. QMN is not responsible for the privacy practices or the content of such websites or services. In some cases, you may be required to provide certain information to register or complete a transaction at such website. These third-party websites have separate privacy and data collection practices and QMN has no responsibility or liability relating to them. We do not endorse, nor are we responsible for the accuracy of, the privacy policies and/or terms and conditions of such website. These third-party entities are independent third parties and are not affiliated with QMN.

10.2 Third-party Content and Advertising - The Site and the App may display advertisements, affiliate links, embedded games, and sponsored content from third parties. When you interact with third-party content or advertising on the Site or within the App, those third parties may collect information about you directly. Clicking on any third-party content or advertisements may add and place cookies on your computer prior to directing you to the applicable third party's site. These third parties have separate cookie policies and QMN has no responsibility or liability relating to them. If you do not wish to receive cookies, you may set your browser to reject cookies or to alert you when a cookie is placed on your computer.

10.3 Third-party Technology Providers - The Site and the App may engage with certain third-party technology and service providers such as data hosting service providers, content providers, marketing and advertising providers, analytics providers, visitor identification and identity resolution providers, video content and advertising providers, ad quality and security monitoring providers, game and interactive content providers, consent management providers, affiliate and monetization partners, and email marketing service providers. Within the App, these providers may include advertising and analytics partners whose tools are integrated directly into the application. These third-party providers have separate privacy and data collection practices and policies, and QMN has no responsibility or liability relating to them. We do not endorse, nor are we responsible for the accuracy of the terms and conditions of any third-party privacy policies. These third-party entities are independent third parties and are not affiliated with QMN. The information collected by such independent third parties may be associated with your Personal Data or they may collect information, including Personal Data, about your online activities over time and across various websites, applications, and other online services.

QMN may be using or sharing your Personal Data for legitimate interest purposes with third-party technology and service providers.

11. Security of Data

In Short: We use industry-standard security measures to protect your personal data, but no method of transmission or storage is completely secure.

QMN is committed to protecting the security of any Personal Data that is collected by us. We use a variety of industry-standard security technologies and procedures to help protect any Personal Data from unauthorized access, use, or disclosure. Despite these measures, no method of transmission over the Internet, or method of electronic storage, is 100% secure. QMN cannot fully eliminate security risks associated with the collection and storage of any Personal Data, including without limitation, any mistakes and security breaches that may happen. While we strive to use commercially acceptable means to protect your Personal Data, we cannot guarantee its absolute security.

12. International Data Transfers

In Short: Your information may be transferred to and processed in countries other than your own, including the United States and Canada. We take appropriate measures to protect your data in connection with such transfers.

Our servers are located in various regions, including the United States and Canada. If you are accessing our Services from outside these regions, please be aware that your Personal Data may be transferred to, stored by, and processed by us in our facilities and in the facilities of the third parties with whom we may share your Personal Data (see "When and With Whom Do We Share Your Personal Information?" above), in the United States, Canada, and other countries.

If you are located in the EU/EEA where European Data Law applies and QMN is required to transfer your Personal Data in accordance with this Privacy Policy, we exert commercially reasonable efforts to ensure that any transfer of your Personal Data outside of the EU/EEA is protected under industry standard contractual clauses, and any subsequent data protection safeguards. Where European Data Law applies, QMN shall not process its collected Personal Data (nor permit its collected Personal Data to be processed) in a territory outside of the EU/EEA unless it has taken such measures as are necessary to ensure the transfer is in compliance with European Data Law. Such measures may include (without limitation) transferring its collected Personal Data to a recipient in a country that the European Commission has decided provides adequate protection for Personal Data, to a recipient that has achieved binding corporate rules authorization in accordance with European Data Law, or to a recipient that has executed standard contractual clauses adopted or approved by the European Commission.

13. Data Retention Period

In Short: We keep your information only as long as necessary to provide the Services or as required by law. When no longer needed, we delete or anonymize it.

Any Personal Data that is collected and stored by QMN will be retained only for as long as required in order to provide the Site, the App, and the Services to you, or as required by applicable law and/or Applicable Data Law. When we have no ongoing legitimate business need to process your Personal Data, we will either delete or anonymize such information, or, if this is not possible (for example, because your Personal Data has been stored in backup archives), then we will securely store your Personal Data and isolate it from any further processing until deletion is possible.

14. Do-Not-Track and Global Privacy Control Signals

In Short: We do not currently respond to DNT browser signals but do honor Global Privacy Control (GPC) signals where required by law.

14.1 Do-Not-Track (DNT)

Most web browsers and some mobile operating systems and mobile applications include a Do-Not-Track ("DNT") feature or setting you can activate to signal your privacy preference not to have data about your online browsing activities monitored and collected. At this stage, no uniform technology standard for recognizing and implementing DNT signals has been finalized. To manage cookies and tracking technologies related to browser-based requests to the Site, you can make your preference known using the Global Privacy Control ("GPC") signal. In Short: We do not knowingly collect data from or market to individuals under 18 years of age.

We do not knowingly collect, solicit data from, or market to individuals under 18 years of age, nor do we knowingly sell such Personal Data. By using the Services, you represent that you are at least 18 years of age. If we learn that Personal Data from users under 18 years of age has been collected, we will take reasonable measures to promptly delete such data from our records.
